1. Acceptance of Terms

These Terms and Conditions ("Terms") form a binding agreement between you ("you," "user") and Mr. Hammy's Hand Me Downs ("Mr. Hammy's," "we," "us," "our"), governing your access to and use of the website located at MrHammys.com and all related features (the "Platform"). By creating an account, browsing listings, buying, selling, donating, or sponsoring on the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2. What Mr. Hammy's Is — and Isn't

Mr. Hammy's is a two-sided online marketplace for secondhand children's clothing and toys. We connect individual buyers and sellers, and we facilitate donations between sponsors and seeker families through the Family Sponsorship Program.

Mr. Hammy's is a facilitator, not a party to transactions between users. We do not own, inspect (beyond automated and spot checks), or guarantee any item listed on the Platform unless explicitly stated. Sellers and donors are solely responsible for the accuracy of their listings and the condition, safety, and legality of the items they offer. Buyers are responsible for reviewing listings carefully before purchasing.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to create an account. Mr. Hammy's is not directed at children, and we do not knowingly permit anyone under 13 to create an account or submit personal information directly to us (see our Privacy Policy for our full children's-privacy approach). Listings and family profiles may describe a user's children (e.g., age in months, sizes needed) — that information is provided and controlled by the parent or guardian account holder, not by the child.

4. Accounts

  • •You must provide accurate, current information when registering and keep your login credentials confidential.
  • •You are responsible for all activity that occurs under your account.
  • •One account per person. Sharing or transferring accounts is prohibited.
  • •We may suspend or terminate accounts that violate these Terms, provide false information, or pose a risk to other users (see Section 14).

5. Buying on Mr. Hammy's

  • •All payments are processed through Stripe Connect. By purchasing, you authorize the charge to your selected payment method.
  • •Purchases may be paid in cash (via Stripe) or with Mr. Hammy Credits, or a combination, where the seller's listing allows it.
  • •Once a sale completes, Mr. Hammy's facilitates payout to the seller, less our platform fee (Section 8).
  • •Mr. Hammy's does not guarantee that an item is exactly as described, but we will assist in resolving disputes involving fraud or items materially not as described (Section 11).

6. Selling on Mr. Hammy's

By creating a listing, you represent and warrant that:

  • •You own the item or have the right to sell it.
  • •The item is not subject to a manufacturer or CPSC recall, and it is not on Mr. Hammy's Prohibited Items list (Section 7).
  • •Your description, photos, condition grade, size, and price are accurate and not misleading.
  • •The item complies with applicable consumer product safety laws, including CPSIA requirements relevant to resold children's products.

You'll receive payouts through Stripe Connect, which requires identity verification before you can list items or receive funds. Mr. Hammy's deducts an 8% platform fee from each completed sale before payout (Section 8). You are responsible for packaging and shipping sold items using the shipping label generated through the Platform, and for providing tracking information.

Sellers, not Mr. Hammy's, are responsible for the safety and legality of items they list. Mr. Hammy's may remove any listing at its discretion, including for suspected recalls, safety concerns, or policy violations.

7. Prohibited Items

You may not list, sell, donate, or otherwise offer on the Platform:

  • •Any item subject to an active CPSC or manufacturer recall
  • •Car seats and booster seats (of any age or condition)
  • •Drop-side cribs
  • •Bicycle and sports helmets
  • •Counterfeit or unauthorized branded goods
  • •Items that fail to meet applicable U.S. consumer product safety standards
  • •Any item prohibited by applicable law

Mr. Hammy's maintains and may update a current Prohibited Items list. Listing a prohibited item is grounds for immediate listing removal and account suspension.

8. Fees

  • •Mr. Hammy's charges a flat 8% platform fee on the seller's proceeds from each completed sale, deducted automatically before payout via Stripe Connect.
  • •Listing "boosts" and other optional promotional features may be purchased with Mr. Hammy Credits or cash; fees for these features are disclosed at the time of purchase.
  • •In states where Mr. Hammy's is legally classified as a "marketplace facilitator," Mr. Hammy's collects and remits applicable sales tax on transactions, as required by law. This does not relieve sellers of their own tax obligations on income earned through the Platform.
  • •We may change our fee structure with notice posted on the Platform; continued use after a fee change takes effect constitutes acceptance.

9. Mr. Hammy Credits

"Mr. Hammy Credits" are a closed-loop virtual credit usable only within the Platform.

  • •Mr. Hammy Credits have no cash value and are not redeemable for cash under any circumstance.
  • •Credits are non-transferable between accounts except through Platform features expressly designed for that purpose (e.g., referral rewards, donation acceptance).
  • •Credits earned through referrals, the Family Sponsorship Program, or promotions expire after 12 months of account inactivity, as disclosed in your account dashboard and via reminder emails at 9 and 11 months of inactivity.
  • •Mr. Hammy's may award, adjust, limit, or revoke credits at its discretion to prevent fraud or abuse of the credit system.
  • •We may modify, suspend, or discontinue the Mr. Hammy Credits program at any time. If we discontinue the program, we will provide reasonable advance notice and an opportunity to use remaining credits before they are forfeited.
  • •Credits are not property, are not insured, and are not a deposit, security, or investment of any kind.

10. Family Sponsorship Program

The Family Sponsorship Program connects "Sponsors" (users with items to give away) with "Seeker Families" (users who opt in to receive donations).

  • •Participation is entirely optional and voluntary on both sides. Mr. Hammy's does not guarantee a match, a donation, or any particular outcome from participating.
  • •Seeker Families control how much personal information is visible to potential sponsors (anonymous, partial, or full visibility) and may accept or decline any sponsorship request or donation offer.
  • •A Seeker Family may have no more than 3 active sponsors at a time.
  • •Donated items are estimated in value by the Sponsor (between $1–$50 per item) for the sole purpose of calculating Mr. Hammy Credits awarded upon the Seeker Family's acceptance. This estimated value is not a representation of fair market value, appraisal, or tax-deductible charitable value.
  • •"First right of refusal" gives a Sponsor's chosen Seeker Family a time-limited window (24/48/72 hours, Sponsor's choice) to claim a new listing before it's made public. If unclaimed when the window expires, the listing automatically becomes public.
  • •Mr. Hammy's is not a party to the relationship between Sponsors and Seeker Families and is not responsible for the conduct, representations, or item condition exchanged between them, beyond the same prohibited-items and safety obligations that apply to all listings and donations.
  • •Donations are not facilitated as registered charitable gifts; Mr. Hammy's makes no representation regarding tax deductibility of donated items.

11. Disputes Between Users

If a buyer believes an item was not as described or a transaction involved fraud, they may open a dispute through the Platform within the window specified in our Return & Refund Policy. Mr. Hammy's will review the dispute and may, at its discretion, refund the buyer (in cash or credits), require the seller to accept a return, or take no action if the claim is unsubstantiated.

For all other disagreements (e.g., buyer's remorse, shipping delays outside our control, cosmetic preferences not addressed in the listing), resolution is between the buyer and seller directly. Mr. Hammy's is not obligated to mediate or compensate either party.

12. Shipping and Returns

  • •Sellers generate shipping labels through the Platform's shipping integration and are responsible for shipping within the timeframe stated in our shipping policy.
  • •Mr. Hammy's is not responsible for items lost, delayed, or damaged in transit once tendered to the carrier, though we will assist in filing carrier claims where applicable.
  • •Returns are handled between buyer and seller except where Section 11 (fraud / not-as-described) applies.

13. Intellectual Property

You retain ownership of photos and descriptions you upload, but grant Mr. Hammy's a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and promote that content on the Platform and in our marketing (e.g., featuring a listing on our homepage or social media). You represent that you have the right to grant this license for any content you upload.

The Mr. Hammy's name, logo, "Mr. Hammy Credits," and Platform design are the property of Mr. Hammy's Hand Me Downs and may not be used without written permission.

14. Suspension and Termination

We may suspend or terminate your account, with or without notice, for violations of these Terms, suspected fraud, repeated policy violations, listing prohibited items, or behavior that harms other users or the Platform. You may close your account at any time; outstanding Mr. Hammy Credits are forfeited upon account closure unless required otherwise by law.

15. Advertising and Third-Party Services

The Platform displays advertising, including through Google AdSense, and uses third-party services for payments (Stripe), shipping (EasyPost), authentication (Google OAuth, Supabase), email (Resend), and analytics (Google Analytics). Your use of the Platform is also subject to those providers' terms where applicable. See our Privacy Policy for details on data shared with these providers.

16. Disclaimers

THE PLATFORM AND ALL LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE." HAMMY'S DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HAMMY'S DOES NOT WARRANT THE SAFETY, CONDITION, LEGALITY, OR ACCURACY OF ANY USER LISTING, DONATION, OR ITEM. USED CHILDREN'S PRODUCTS CARRY INHERENT RISK; BUYERS AND RECIPIENTS ASSUME RESPONSIBILITY FOR INSPECTING ITEMS BEFORE USE BY A CHILD.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAMMY'S AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION, DONATION, OR SPONSORSHIP CONDUCTED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO HAMMY'S IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

Some jurisdictions do not allow the exclusion of certain warranties or damages, so some of the above limitations may not apply to you.

18. Indemnification

You agree to indemnify and hold Mr. Hammy's harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your listings, items, donations, sponsorships, or violation of these Terms or applicable law.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Platform will be resolved in the state or federal courts located in Florida, and you consent to personal jurisdiction there.

20. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version with a new "Last updated" date and, for material changes, provide notice (e.g., email or in-app banner). Continued use of the Platform after changes take effect constitutes acceptance.
